Terms and Conditions for a R.O.S.C.A. Money Circle App
Please read these Terms and Conditions carefully before using the App.
1. Introduction
These Terms and Conditions ("Terms") govern your use of the R.O.S.C.A. Money Circle application (the "App") and related services (collectively, the "Services"). The App is owned and operated by Nopal Pintado, LLC ("Company", "we", "us", or "our").
2. Acceptance of Terms
By accessing or using the App, you agree to be bound by these Terms and any applicable laws and regulations. If you do not agree to these Terms, you may not access or use the App.
3. Modifications to Terms
We reserve the right to modify these Terms at any time. Any such modifications will be effective upon posting the modified Terms on the App. Your continued use of the App following the posting of modified Terms will be deemed acceptance of such modifications.

You must be at least 18 years old and have the legal capacity to enter into contracts in order to use the App.

To use certain features of the App, you may need to create an account. You agree to provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account information and password, and you are responsible for all activities that occur under your account.
6. Use of the App
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to use the App:

For any purpose that is harmful, offensive, or obscene.
To infringe upon the intellectual property rights of others.
To transmit any viruses or other harmful code.
To interfere with or disrupt the App or the servers or networks connected to the App.
To attempt to gain unauthorized access to the App or any related systems.
7. User Content
You are solely responsible for any content you submit, post, or transmit through the App ("User Content"). You agree not to submit User Content that is:
Illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, racially, ethnically, or otherwise objectionable.
Infringes on any intellectual property rights of any other person or entity.
Contains any software viruses or other harmful code.
Is commercially exploitable or advertises any commercial entity.
Impersonates any person or entity, or otherwise misrepresents your affiliation with a person or entity.
We reserve the right to remove any User Content that we deem to be in violation of these Terms.
8. Intellectual Property
The App and its contents are protected by intellectual property laws. You agree not to modify, copy, distribute, transmit, display, sell, license, create derivative works, or otherwise exploit any content from the App, in whole or in part, without our prior written consent.
9. Third-Party Services
The App may contain links to third-party websites or services. We are not responsible for the content or practices of any third-party website or service. You are advised to read the terms and conditions and privacy policies of any third-party website or service you visit.
10. Disclaimer of Warranties
THE APP AND THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE APP OR THE SERVICES WILL BE UNINTERRUPTED, SECURE, RELIABLE, OR ERROR-FREE.
11. Limitation of Liability
WE SHALL NOT BE LIABLE FOR ANY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES, ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THE APP OR THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to indemnify and hold us harmless from and against any and all claims, losses, damages, liabilities, costs, and expenses (including attorneys' fees) arising out of or relating to your use of the App or your violation of these Terms.
13. Termination
We may terminate your access to and use of the App at any time, for any reason, without notice. You may also terminate your account at any time.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.
